A Sunyani-based legal luminary, Nana Obiri Boahen, has petitioned the Chief Justice, Justice Akwasi Anin-Yeboah, over an alleged derogatory claim by his opponent that with money one can buy his/her way through every court case.
The said opponent, owner of Golden Age Company, according to Obiri Boahen’s petition, has constantly boasted around in Sunyani and beating his chest that at all costs the case that was pending before the Court of Appeal would be handled in his favour.
The following is the full petition.
PETITION TO THE CHIEF JUSTICE OF GHANA FOR A SERIOUS AND THOROUGH ATTENTION, INVESTIGATION AND REDRESS
Respectfully my Lord the Chief Justice; I am the 1st defendant in the above quoted appeal which is currently pending before the Supreme Court of Ghana.
My lord; permit me to state unreservedly that; during the pendency of this matter before the court of Appeal; the Plaintiff/Respondent/Respondent consistently kept boasting that, the verdict of the appeal was going to be delivered in his favour. Truth to his boastings; and notwithstanding the abundance of evidence on record; which weighed heavily against the plaintiff/respondent, the matter went against me.
SUPREME COURT SAGA
For some time now, my Lord; the Plaintiff/Respondent/Respondent has been going around in Sunyani beating his chest and boasting that, at all cost, “I have won the appeal very soon; I am going to pull down plenty buildings with money you can buy through every court case”. The plaintiff constantly boasts around and witnesses are available to testify to that. This boasting; cannot be considered as mere rhetoric. In fact, on the 8th day of July, 2020, the plaintiff/appellant/appellant came to court, in white suit, white trousers and a white shoe. In fact, he even pulled a white handkerchief to wipe his face in the presence of his lawyer.
SUBJECT MATTER OF THIS PETITION
My Lord; the Chief Justice, I am by this petition praying that, you set up a high-powered body to go into this petition and determine its implication and consequences on the judicial system and the judiciary as a whole. In fact, I have ample and an avalanche of evidence, living witnesses, etc. who have enough and sufficient evidence to support and augment the basis of this petition, its ramifications on the judicial system and the security implications.
Permit me; my Lord, the Chief Justice to conclude this petition by quoting the words of Benin JSC in NANA YEBOAH-KODIE ASARE II AND ANOTHER V NANA KWAKU ADDAI AND OTHERS Suit NO. J7/20/2014. Dated 12th February, 2015.
“There is overriding public interest that, there should be confidence in the integrity of the administration of justice in the country. Ordinarily, judicial adjudication must always be fair and reasonable, nurtured on the wings of humility and understanding. This understanding must never be lost. The traditional image of the goddess of justice is a fair, maiden, blind folded and holding a raised sword in her right hand pointing to the sky and a pair of weighing scales. She is presented as the veritable incarnation of judicial virtue.”
This is my humble petition; I pray that, same be attended to with the necessary attention, a high-powered committee set up to look into the seriousness of this petition.
