The wife of former Chief Executive Officer of the National Food Buffer Stock Company (NAFCO), Hanan Abdul-Wahab Aludiba, has filed an application at the High Court in Accra, seeking an order of habeas corpus to compel the Bureau of National Investigations (BNI) and the Attorney-General to produce her husband before the court.
The application, filed by Hajia Faiza Seidu Wuni, contends that her husband has been in the custody of the BNI since July 4, 2026 following his arrest at the Accra International Airport, despite having been granted leave by the High Court to travel abroad for medical treatment.
According to the affidavit in support of the application, Hajia Wuni said her husband was being investigated by the Economic and Organised Crime Office (EOCO), leading to criminal charges being filed against him on May 15, 2026.
She stated that on June 29, 2026 the trial court granted Abdul-Wahab permission to travel outside Ghana to seek treatment for a serious eye condition.
Following the court’s order, she said he made travel arrangements and was scheduled to depart on July 4.
The affidavit claims that after completing all immigration and pre-departure formalities at the Accra International Airport, Abdul-Wahab was allegedly arrested by heavily armed men who identified themselves as officers of the BNI.
Hajia Wuni alleged that her husband was not informed of the reasons for his arrest nor of his constitutional rights, including his right to legal representation.
She further deposed that Abdul-Wahab briefly contacted his lawyer, Godfred Yeboah Dame, who sought to speak with the arresting officers, but was allegedly refused.
According to the affidavit, she later saw a Facebook post by the Deputy Attorney-General alleging that her husband had been arrested over “an attempt to empty his frozen bank accounts.”
The applicant, however, denied the allegation, describing it as false and calling on the respondents to prove the claim.
The affidavit further alleges that efforts by family members to locate Abdul-Wahab immediately after his arrest proved unsuccessful until July 5, when they were informed that he was being held at the BNI Headquarters in Accra.
Hajia Wuni said she was denied permission to deliver food to her husband during a visit to the BNI Headquarters because officers informed her that visitors were not allowed on weekends.
She also alleged that lawyers representing Abdul-Wahab were refused access to him despite identifying themselves and requesting to provide legal services.
According to the affidavit, BNI officers informed the lawyers that they “do not work on weekends” and that lawyers could only see detainees with authorization from their superiors.
The applicant contends that the refusal to grant family members and lawyers access to Abdul-Wahab, coupled with the failure to disclose any specific offence for which he was being detained, constitutes a violation of his constitutional rights to personal liberty, dignity and legal representation.
She further argues that the arrest and continued detention were calculated to frustrate the High Court’s order permitting him to travel abroad for urgent medical treatment.
Hajia Wuni is, therefore, praying the High Court to issue an order of habeas corpus ad subjiciendum, directing the Director of the BNI and the Attorney-General to produce Abdul-Wahab before the court and justify the legality of his continued detention.
