Lawyers of the embattled police chief, ACP Dr Benjamin Agordzo have challenged the jurisdiction of the Kaneshie district court hearing the alleged treason case against their client.
According to them, the charge of treason which is a first-degree felony does not fall under the ambit of the district court.
One the lawyers, Hamdiya Mohammed, stated that no bill of indictment had been presented before the court hence the issue of committal could not arise.
The lawyers further stressed that due to the lack of jurisdiction, the court could not remand or grant bail.
The prosecution objected to the stance of the defence saying the court was well placed to hear the case.
The prosecutor, ASP Sylvester Asare explained that the district court was a court of first instance for indictable cases.
However, the magistrate, Eleanor Kakra Bans Botwe adjourned the case to the 8th of November 2019 for a ruling on the matter but remanded the accused person.
He believes he is being victimized due to how he freely expresses himself as a citizen.
Speaking after his first court appearance on Wednesday, he denied any involvement in an alleged plot to destabilize the State.
“The charges are frivolous. I am as strong as anything. Nobody should bog me, I have not committed any crime. I have done nothing wrong. The President called upon us to be citizens so when I express my opinion on WhatsApp platforms unrelated to any alleged coup, nobody should bog me down. I will stand for this till the end. You cannot break me down because I am strong for anything,” he told newsmen.
He was arrested on Monday and interrogated through to Tuesday by the Bureau of National Investigations over his alleged involvement in the suspected plot by some persons to destabilize the country.
He is the third top police officer invited and questioned for alleged involvement in the supposed plot.
