The Kaneshie District Court has dismissed the preliminary objection by lawyers of Assistant Commissioner of Police (ACP), Dr. Benjamin Agordzo, challenging the jurisdiction of the court hearing the case brought against their client.
According to the ruling by the Magistrate, Eleanor Kakra Bans Botwe, the District Court was clothed with jurisdiction to hear this matter as the court of the first instance.
She explained that the District Court is where the committal process takes place in cases tried by indictment and hence has the authority to hear the case.
She was also surprised at the arguments of the defense lawyers who raised constitutional issues with her jurisdiction.
In response to the argument of the defense lawyers about the non-availability of a bill indictment on the first day, the Magistrate also questioned how the bill can be ready in 48 hours when investigations are ongoing with the matter.
There is heavy security presence however at the court ahead of the second appearance of ACP Dr. Benjamin Agordzo for his alleged involvement in an alleged destabilization plot.
Family members and friends were at the court to solidarize with their relative who they believe is innocent of the treason charges leveled against him.
