Accra, March 25, GNA - A 25-year-old trader who is standing trial for allegedly defiling a 14-year-old girl at Agbogboloshie, on Monday told an Accra Circuit Court that he is unable to read the documents given him by the prosecution.
Prosecution in cases are bound by law to make disclosures by providing accused persons with documents they intend to rely on during trial.
Yakubu Moro, the accused informed the court that although the prosecution has furnished him with the documents it intends to rely on, he could not read them.
According to Moro, who has no legal representation, he is unable to get someone to read and interpret the contents of the documents to him whiles in custody.
Prosecution has indicated that it gave the documents to the accused two weeks ago.
The court presided over by Mrs. Rita Abrokwah Doko then ordered Detective Inspector Fidelia Folivi of the Greater Accra Domestic Violence and Victim’s Support Unit (DOVVSU) to read and interpret the documents to the accused person so that the trial could commence.
The court informed Moro that the offence he was facing was a serious one and needed to get someone to read and interpret them to him for him to put up his defence.
Although Moro has been granted bail, he is unable to execute the bail saying all his relations are in the Northern Region and that he could only get one person to stand as surety for him.
He therefore pleaded with the court to also reduce the three sureties to one.
The matter was therefore adjourned to April 8.
The Ghana News Agency has observed that Moro’s challenge of not being able to read, brings to bear some of the challenges facing law on disclosures in criminal trial.
Prosecuting earlier, Sergeant Opoku Aniagyei told the court that Moro a trader is accused of defiling a 14-year-old girl at Agbogbloshie.
Charged with defilement, Moro has pleaded not guilty.
Prosecution said the complainant aged 35 is a dispatch rider residing at Agbogboloshie, Accra whiles the victim is the complainant’s daughter.
The Prosecution said the complainant had information that the accused has been having sexual intercourse with the victim so the complainant kept surveillance on them.
He said on January 1, this year, at about 2200 hours the complainant had information that the victim had visited Moro in his room.
Prosecution said the complainant went to Moro’s room and found the victim and the accused seated on a mattress.
He said when the complainant quizzed the victim, she disclosed that Moro has had sexual intercourse with her on four occasions.
Mr Aniagyei said a report was made to the Police at Old Fadama and an Extract of Occurrence was given to the complainant to be taken to the DOVVSU in the Greater Accra Region where a medical report form was issued to the complainant to send the victim to the hospital for examination.
The Prosecution said Moro was later arrested by the Police and taken to the crime scene where he admitted having sex with the victim on four occasions.
