An unemployed man at Fiapre, a suburb of Sunyani Awudu Ali, has sued the Inspector General of Police (IGP) John Kudalor and three others over wrongful detention.
The Attorney General’s Department, Police Corporal Adams Mamudu and the Brong-Ahafo Regional Commander of the Ghana Prison Service (GPS) are other defendants in the suits.
He is seeking an order by a Sunyani High Court for payment of compensation of GH?1 million for the violation of his fundamental human rights.
An affidavit filed by his counsel, Foster Akwasi Asante of the “Enso Nyameye Chambers”, said his personal liberty was unjustifiably and unlawfully curtailed by the defendants from March to July this year.
It stated that Ali together with two other persons were arraigned on January 15, 2015, for abetment of crime.
The Fiapre Circuit Court, presided over by Mr. Yaw Owoahene Acheampong, remanded him into lawful custody and adjourned the case to 29 January, after he (Ali) had pleaded not guilty to the offence.
The affidavit said when the case was heard on March 03, same year, the plaintiff was admitted to bail in the sum of GH?3,000.00 with a surety.
After several adjournments a High Court Judge, Mrs. Ananda Aikins, sitting as additional Circuit Court Judge, struck out the case for want of prosecution and subsequently discharged the plaintiff on March 01, this year.
“Notwithstanding the fact that I had on the day of March 1, 2016 been lawfully discharged, the defendants continuously and unlawfully kept me at the central prisons on an expired warrant”, the affidavit added.
It said Ali on March 14, fell ill and as his health condition kept deteriorating at the central prisons the prosecutor, Corporal Mamudu, picked him to the hospital.
The prosecutor later took him to the regional police command where his discharge was confirmed.
“When I accosted the prosecutor on my unlawful custodial detention he apologized to me and gave me his telephone number and GH?10.00 to use as lorry fare to my destination” the affidavit added.
