Accra, Dec. 11, GNA - A Nursing Officer with the Tamale Teaching Hospital has said, he would pursue a contempt application against the Ghana Registered Nurses and Midwives Association (GRNMA) for holding a congress to elect its national executives despite a court injunction to that effect.
Mr Salifu Abdul Majeed Sakiwine told the Ghana News Agency in Accra that a Human Rights High Court in Accra on November 27, this year, granted an injunction against the GRNMA thereby preventing the association from going ahead to hold elections for its’ national executives.
Mr Sakiwine said the injunction was served on the association on November 27, this year but the GRNMA went ahead with the elections hence the contempt application.
In an earlier writ of summons filed before the Court, the nursing officer was seeking true and proper interpretation of Article 37 (1)( a) of the GRNMA Constitution that no election for national officer/ executive election could be held unless notice of the said election was published in the national dailies, notice boards of the GRMA national and district secretariat, regional and district hospitals at least six months before delegates Congress for that purpose.
Plaintiff is also seeking a declaration that non-publication of the notice of the elections on notice boards of the Tamale Teaching Hospital (the Northern Regional Hospital) as well as the GRNMA Regional Secretariat for at least six months, is in contravention of Article 37 (1) (a) of the Association's constitution.
He was so seeking an order of injunction restraining the defendant, its officers, agents and whoever claiming through them to hold any elections whatsoever.
It is the case of the plaintiff that he is a fully paid up member of the GRMA.
The plaintiff averred that the GRMA in 2019 adopted a Constitution by which its affairs were to be governed.
According to the plaintiff the rationale for the constitutional provision was to ensure that all members of GRMA desirous of contesting for the various national executive positions can do so accordingly.
He further held that contrary to the laid down mandatory provision in Article 37 (1)(a) the GRNMA failed to publish the notice of the election on regional notice boards of the Tamale Teaching Hospital which served as the regional Secretariat.
The plaintiff avers that due to the non- compliance of the defendants Article 37 (1)(a) of the GRNMA’s constitution, the subsequent act such as the impending election at the time was null and void.
The plaintiff was therefore seeking an order of the court to compel the defendant association not to proceed with the elections.
Meanwhile when the matter was called at the Human Rights Court on Monday, defendant's lawyer prayed the court for an extension of time to respond.
The court presided over by Mrs Justice Gifty Addo granted the defendant's request.
